Preliminary Examination
One of the important parameters in examining any transaction is the jurisdiction responsible for the registration of rights. A property whose ownership rights are registered with the Israel Land Registry (‘Tabo’) is different from property whose lease rights are registered with the Israel Land Administration.

 

In addition, the nature of the property is of great importance. For example, with a condominium, we verify there is a match between the condominium in its current condition, versus its registration on the original condominium plan. On the other hand, for a private house registered with other houses on the same plot, we verify the existence and registration of a co-ownership agreement, which is similar to land owned by several parties.
Finance Management
Since the purchase of a property is one of the largest and most significant transactions in a client's life, the firm examines, together with the client, all the transaction costs and financing options available. In examining the costs, the purchase tax liability is considered, because the goal is to make the right transaction for the customer, while taking advantage of any potential tax relief available.

 

In addition, the firm accompanies the client in the process of securing a mortgage - or closing / transferring a mortgage, and helps the client change the payment dates most appropriate to the client’s needs. In order to protect a customer who purchases a property from a contractor, the firm ensures that the customer receives a bank guarantee or insurance policy from the contractor in accordance with the law for each payment made.

Negotiations
Proper negotiation can only be carried out by understanding the transaction and the customer's needs; both legal and commercial.
 
The firm focuses on the most important issues for its clients. Since we also represent developers who sell new properties, we have the advantage of understanding the critical issues. As such, we can effectively advise clients who want to purchase a new apartment, to say nothing about second-hand apartment transactions, that are typically less complex.
 
Effective negotiations that serve the client's interest can only be carried out by an attorney who specializes in the field and has extensive experience in the profession.
Acquisition of Property
The firm accompanies the client until they obtain ownership of a property, ensuring sufficient funds are available to guarantee the completion of the transaction. The firm ensures property rights are registered in the name of the client.
 
When purchasing a new apartment from a contractor, the firm instructs the client regarding the registration of a delivery protocol in order to ensure that the contractor corrects any defects, as required by law. In addition, since it is not possible to register the property in the client's name until completion of the full payment, the firm verifies that the client's rights are guaranteed by registering a ‘warning note’ prior to relinquishing the security or the contractor’s insurance policy.
